Terms of Service

1. The service

Rundun is a checklist execution platform. It allows organisations to create checklist templates, dispatch them as runs via shareable links, collect structured answers and photos from the people completing those runs, and retrieve the results.

We reserve the right to modify or discontinue the service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.

2. Accounts

You must sign in using a supported OAuth provider (Google, Microsoft, or Apple). You are responsible for all activity that occurs under your account. You must provide accurate information and keep it up to date.

You must be at least 16 years old to create an account. By creating an account you represent that you meet this requirement.

One person may not maintain multiple active accounts. Accounts are not transferable.

3. Organisations

When you create an account, an organisation is created automatically. You may create additional organisations and be invited to others. Each organisation is a separate billing entity. You are the owner of any organisation you create.

As an organisation owner or admin, you are responsible for the conduct of members and guests you invite and for the content of the checklists and runs created within your organisation.

4. Acceptable use

You agree not to use Rundun to:

• Violate any applicable law or regulation
• Send unsolicited checklists in bulk or for spam purposes
• Collect data about people without their knowledge or a lawful basis
• Upload or distribute malware, illegal content, or content that infringes third-party rights
• Attempt to gain unauthorised access to any account, system, or network
• Reverse engineer, decompile, or extract the source code of the service
• Resell or sublicense access to the service without written permission

We may suspend or terminate accounts that violate these rules without notice.

5. Billing and payments

Rundun offers pay-as-you-go run packs and monthly subscription plans. Prices are shown at rundun.app/pricing. All payments are processed by our payment processor, which acts as the merchant of record and handles all tax obligations globally.

Subscriptions renew automatically each month until cancelled. You may cancel at any time from your billing settings. Cancellation takes effect at the end of the current billing period — no partial refunds are issued for unused time.

PAYG credits expire 12 months from purchase. Expired credits are not refunded.

Refunds are issued at our discretion for technical failures that prevent you from using the service. Contact billing@rundun.app within 14 days of the charge.

Prices may change. We will give at least 30 days’ notice of price increases to subscribers.

6. Free access for members and guests

Users in the member or guest role within an organisation will never be charged by Rundun. Billing applies only to organisation owners. We reserve the right to introduce reasonable limits on free usage in the future with 30 days’ notice.

7. Your content

You retain ownership of all content you create in Rundun — checklist templates, run answers, uploaded photos, and other data (“Your Content”).

By using Rundun you grant Elmeris LLC a limited, non-exclusive licence to store, process, and display Your Content solely to provide the service to you and your organisation. We do not claim ownership of Your Content and we do not use it for any purpose other than operating the service.

You are responsible for ensuring you have the rights to any content you upload or collect through Rundun, including obtaining proper consent from the people who complete your checklists where required by law.

8. Data export and portability

You may export your run data at any time from your account settings. Exports include all answers, photo files, timestamps, and GPS data associated with your runs. We will continue to offer export for at least 90 days after account termination.

9. Intellectual property

Rundun, its logo, and all software, designs, and documentation created by Elmeris LLC are owned by Elmeris LLC and protected by copyright, trademark, and other laws. Nothing in these Terms grants you any right to use our trademarks or branding without written permission.

10. Termination

You may delete your account at any time from your account settings. We may suspend or terminate your access if you violate these Terms, fail to pay outstanding amounts, or for any other reason with reasonable notice.

Upon termination, your access to the service ends. Your data is deleted according to our retention schedule described in the Privacy Policy.

11. Disclaimers

The service is provided “as is” and “as available” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any defects will be corrected.

12. Limitation of liability

To the fullest extent permitted by law, Elmeris LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service. Our total liability for any claim arising from these Terms or your use of the service is limited to the amounts you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Elmeris LLC and its officers, employees, and contractors from any claims, damages, or expenses (including legal fees) arising from your use of the service, your violation of these Terms, or your violation of any third-party rights.

14. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any dispute arising under these Terms will be resolved by binding arbitration administered under the American Arbitration Association's Consumer Arbitration Rules, with the seat of arbitration in Sheridan County, Wyoming.

You waive any right to participate in a class action lawsuit or class-wide arbitration against Elmeris LLC.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes we will notify you by email and update the effective date above. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
